PART FOUR – Consumer Contracts
CHAPTER FIVE – Other Consumer Contracts
Article 50 – Contracts for Timeshare and Long-Term Holiday Services
(1) A timeshare contract is a contract concluded for a period exceeding one year that gives the consumer the opportunity to stay overnight once or more during multiple periods within that period.
(2) (Amended:24/3/2022-7392/8 art.) Whether the right provided under timeshare contracts is a personal or real right, or whether the timeshare is sold through financial leasing, does not prevent the application of this article. Except for contracts granting a timeshare ownership right established under the provisions of Chapter Eight of the Condominium Law No. 634 dated 23/6/1965, a timeshare contract granting consumers a real right linked to a share of ownership may not be concluded. The right to a timeshare may not be granted by way of membership in a cooperative or participation in a commercial company, or membership in an association or foundation. Those who do not hold a real right over the property subject to the timeshare may not sell timeshares.
(3) A long-term holiday service contract is a contract concluded for a period exceeding one year that grants the consumer the right to benefit from discounts or other advantages relating to accommodation, or to cases where travel or other services are offered together with accommodation, during the specified period.
(4) At least one day before the conclusion of the following contracts, consumers must be provided with a pre-contractual information form containing the matters determined by the Ministry:
a) Timeshare contracts
b) Long-term holiday service contracts
c) Exchange contracts
ç) Resale contracts under which the seller or supplier assists the consumer in buying or selling a timeshare or long-term holiday service.
(5) Except for contracts concluded through distance selling, the seller or supplier is obliged to ensure that the consumer writes the date of the contract in their own handwriting and signs the contract. A copy of these contracts, concluded in writing or at a distance, must be provided to the consumer on paper or through a durable data medium. Provisions of laws requiring stricter formalities are reserved.
(6) The consumer has the right to withdraw from the contract within fourteen days without giving any reason and without paying any contractual penalty. Before the withdrawal period expires, the seller or supplier may not request the consumer to make any payment under any name or to provide any document that places the consumer under an obligation. (Added sentences:24/3/2022-7392/8 art.) If any amount is collected from the consumer despite this prohibition, the amount collected shall be refunded to the consumer immediately. In addition, any document placing the consumer under an obligation is invalid as regards the consumer. Timeshare and long-term holiday service contracts, and all resale, exchange and other related contracts concluded together with these contracts, automatically terminate upon the exercise of the right of withdrawal.[15]
(7) If the price payable by the consumer is covered in whole or in part by a lender on the basis of an agreement between the seller or supplier and the lender, where the consumer withdraws from the contract and the notice thereof is also sent to the lender within the withdrawal period, the linked credit agreement shall also terminate without any obligation to pay compensation or a contractual penalty.
(8) (Amended:24/3/2022-7392/8 art.) A prepaid timeshare contract may not be concluded with consumers, including contracts granting a timeshare ownership right.
(9) (Amended:24/3/2022-7392/8 art.) Except for contracts granting a timeshare ownership right, timeshare contracts shall be concluded for a maximum period of ten years.
(10) (Amended:24/3/2022-7392/8 art.) If the consumer notifies the supplier at least ninety days before the date on which the holiday begins that they will not exercise, for a specified period, the holiday right arising from a timeshare contract granting a personal right, no amount under any name may be claimed from the consumer for that period.
(11) The content of timeshare, long-term holiday service, resale and exchange contracts and of pre-contractual information, the rights and obligations of the consumer, seller and supplier, the right of withdrawal (…)[16] and other procedures and principles of implementation shall be determined by regulation.
Article 51 – Package Tour Contracts
(1) A package tour contract is a contract under which at least two of the following services are sold or promised to be sold together by package tour organisers or intermediaries at an all-inclusive price, and the service covers a period of more than twenty-four hours or includes overnight accommodation:
a) Transport
b) Accommodation
c) Other tourism services not ancillary to transport and accommodation services.
(2) The provisions of this article shall also apply where the details of the tour are determined by the package tour organiser, intermediary or consumer, or where the services within the same package tour are invoiced separately.
(3) Where the package tour organiser has no representative in Türkiye, the package tour intermediary shall be liable as if it were the package tour organiser.
(4) Before the conclusion of a package tour contract, a brochure for pre-contractual information purposes must be provided to the consumer.
(5) Package tour organisers or intermediaries must provide the consumer with a copy of package tour contracts concluded in writing or at a distance, on paper or through a durable data medium.
(6) If one of the essential elements of the package tour contract changes for reasons not attributable to the consumer, or the tour is cancelled before it begins, the consumer has the right to accept this change or an alternative tour offered by the package tour organiser, or to withdraw from the contract. If the consumer withdraws from the contract, the package tour organiser or intermediary is obliged to refund immediately, without any deduction, the entire amount paid by the consumer, starting from the date on which the notice of withdrawal reaches it.
(7) The consumer has the right to request a reduction in the price due to any deficiency arising during performance of the contract. If it is established after the tour has begun that the package tour organiser has not fulfilled or cannot fulfil an important obligation, the consumer may withdraw from the contract. In these cases, the package tour organiser’s or intermediary’s right to claim a fee ceases. Payments made must be refunded to the consumer immediately from the date of withdrawal from the contract. However, the package tour organiser may request from the consumer appropriate consideration for the obligations it has performed up to that point, in proportion to the consumer’s benefit from the service.
(8) Without prejudice to the provisions of the Travel Agencies and Union of Travel Agencies Law No. 1618 dated 14/9/1972 concerning compulsory insurance, the package tour organiser is liable for any damage suffered by the consumer due to non-performance or improper performance of the contract. The consumer may also claim appropriate compensation for wasted holiday time.
(9) Persons who use package tour services within the framework of their commercial or professional activities shall also be deemed consumers.
(10) Pre-contractual information, the content of the contract, transfer of the package tour, conditions for making changes to the contract and the consumer’s rights in such cases, the consequences of cancellation of the package tour, the liabilities of the package tour organiser and intermediary, the cases in which the consumer may claim compensation, withdrawal from the contract and its consequences, and other procedures and principles of implementation shall be determined by regulation.
Article 52 – Subscription Contracts
(1) A subscription contract is a contract that enables the consumer to acquire a particular good or service continuously or at regular intervals.
(2) A copy of these contracts, concluded in writing or at a distance, must be provided to the consumer on paper or through a durable data medium.
(3) Provisions stipulating that fixed-term subscription contracts will be extended for the specified period may not be included in the contract; however, after the subscription contract is concluded, it may be extended if the consumer makes a request or gives approval before the date on which the contract expires.
(4) The consumer has the right to terminate an indefinite-term subscription contract or a fixed-term subscription contract with a term exceeding one year at any time, without giving any reason and without paying any contractual penalty. If the seller or supplier changes the terms of a fixed-term subscription contract with a term of less than one year, the consumer may also terminate the contract. It is sufficient for the notice of termination to be sent to the seller or supplier on paper or through a durable data medium. The seller or supplier may not prescribe a method for terminating the subscription contract that entails more onerous conditions than the method used to establish the contract.
(5) The seller or supplier is obliged to fulfil the consumer’s request to end the subscription within the periods specified by regulation. If the subscription is not terminated within the specified periods, no amount may be claimed from the consumer after those periods expire, even if the good or service has been used. The seller or supplier is obliged to refund, without deduction, the remaining portion of the fee paid by the consumer within fifteen days from the date on which the notice of termination takes effect.
(6) The seller or supplier is obliged to take the necessary measures to carry out transactions relating to notices and requests concerning termination of the subscription contract and, where necessary, to establish an appropriate system and keep it continuously available.
(7) The mandatory content of the contract, the rights and obligations of the consumer, seller and supplier, and other procedures and principles of implementation shall be determined by regulation.
Article 53 – Promotional campaigns organized by periodical publishers
(1) In promotional campaigns organized by periodical publishers in which, for whatever purpose and by whatever means, the provision or promise of a second good or service in addition to the periodical is made through tickets, coupons, participation numbers, games, draws or similar means, no good or service other than cultural goods or services compatible with the objectives of periodical publishing determined by regulation may be provided.
(2) The duration of promotional campaigns that require the purchase of more than one issue of a periodical and extend over a specified period may not exceed seventy-five days for daily periodicals, eighteen weeks for weekly periodicals, and twelve months for periodicals published at longer intervals.
(3) A periodical publisher is required to announce in advertisements for the promotional campaign the schedule for delivery and performance throughout Türkiye of the good or service covered by the campaign, and to complete delivery and performance of that good or service within forty-five days from the end of the promotional campaign.
(4) During the promotional campaign, the sale price of the periodical may not be increased due to the increase in costs arising from the good or service promised as a second product. The consumer may not be required to pay all or part of the price of the good or service covered by the promotional campaign.
(5) The promise and distribution of the good or service covered by the promotional campaign may not be divided, and inseparable or complementary parts of that good or service may not be made the subject of a separate promotion. For the purposes of the implementation of this Law, transactions relating to each good or service promised as a second product shall be deemed an independent promotional campaign.
(6) Promotional campaigns that are not organized by periodical publishers but are directly or indirectly associated with a periodical are also subject to the provisions of this Article.
(7) The procedures and principles relating to promotional campaigns shall be determined by regulation.
