Mediation & Arbitration
Resolve Disputes Without the Courtroom
Not every dispute needs to go to trial. Mediation and arbitration offer faster, more flexible, and often more cost-effective paths to resolution. In Türkiye, mediation is mandatory for certain categories of disputes — including commercial cases and employment claims — before a lawsuit can be filed.
At Yilmaz Attorneys, we represent clients in both mediation and arbitration proceedings, domestically and internationally. Whether you are seeking to resolve a dispute efficiently or enforcing an arbitral award across borders, we guide you through the process.
Mediation in Türkiye
Turkish law requires mandatory mediation as a pre-condition to litigation in several areas:
Commercial disputes — All disputes between merchants or arising from commercial transactions must go through mediation before court.
Employment disputes — Claims related to wages, severance, reinstatement, and workplace compensation require mediation first.
Consumer disputes — Certain consumer claims must be mediated before proceeding to court.
We also represent clients in voluntary mediation where both parties agree to attempt resolution outside the courtroom. Our approach is pragmatic — we pursue settlement when the terms are fair and prepare for litigation when they are not.
Arbitration
Arbitration provides a private, binding dispute resolution mechanism that is particularly common in international commercial relationships. We handle:
Domestic arbitration — Proceedings under Turkish arbitration law for disputes with arbitration clauses.
International arbitration — Representation in proceedings under ICC, ISTAC, LCIA, and other institutional rules.
Arbitration clause drafting — Ensuring your contracts contain effective and enforceable arbitration provisions.
Arbitral award enforcement — Enforcing domestic and foreign arbitral awards in Turkish courts, including under the New York Convention.
Setting aside proceedings — Challenging arbitral awards where grounds for annulment exist.
Why Work with Yilmaz Attorneys
Our team combines courtroom litigation experience with ADR expertise. We understand when alternative resolution serves our clients’ interests and when it does not — and we advise accordingly.
