How much can the rent go up at renewal?

For residential and roofed commercial leases in Türkiye, the annual increase may not exceed the 12-month average change in the consumer price index (CPI) published by TÜİK. Enter the current rent and the renewal month to see the maximum.

The CPI average of the previous month applies.

The legal cap

Article 344 of the Turkish Code of Obligations (No. 6098) caps rent increases at the 12-month average CPI for the month before renewal, even if the contract states a higher rate. After five years, either party may ask the court to set a new rent. Rents agreed in a foreign currency may not be increased for five years.

How the rent increase is calculated

This calculator uses the current monthly rent and renewal month to calculate the increase rate, the increase amount and the new monthly rent. It covers residential property and roofed workplaces. The result depends on the legal ceiling for the renewal period and any lower increase agreed in the lease.

Under Article 344(1) of the Turkish Code of Obligations (Law No. 6098), the consumer price index (CPI; TÜFE) measure is an upper limit. It does not automatically apply as the increase for every lease. Any lower contractual rate must also be taken into account.

  • Current monthly rent (TRY): enter the existing monthly rent as the starting amount.

  • Renewal month: select the month when the lease renews. The relevant CPI data is for the previous month.

  • Property: choose Residential or Commercial (roofed workplace). The historical temporary residential cap does not apply to roofed workplaces.

  • Increase agreed in the contract (%, optional): enter the agreed percentage for comparison with the applicable ceiling.

  • First lease started (optional): enter the starting month for consideration of the five-year rule.

  • Rent is in a foreign currency: select this checkbox if the rent is denominated in a foreign currency. The special rule is explained below.

  • Multiply the current monthly rent by the applicable percentage to find the increase. Add that amount to the current rent to find the new monthly rent.

Which month’s CPI data applies

The relevant measure is the CPI percentage change based on twelve-month averages, published by the Turkish Statistical Institute (TÜİK). The calculation uses data for the month before the selected renewal month. Monthly inflation and the change based on twelve-month averages are different measures and cannot be used interchangeably.

TÜİK publishes the data on the third day of each month, or by the fifth day depending on calendar adjustments. The calculator uses monthly TÜİK data dating back to 2018. If the necessary data has not been published, it does not estimate a rate or use an earlier rate for the new period.

The legal ceiling and the historical residential cap

Article 344(1) limits an ordinary renewal increase by reference to the CPI change based on twelve-month averages in the preceding rental year. This ceiling applies to residential and roofed workplace leases. A contractual percentage above the ceiling does not override it; the excess is invalid.

For residential leases renewing between 11 June 2022 and 1 July 2023, a temporary 25% cap applied under Provisional Article 1 of the Turkish Code of Obligations, introduced by Law No. 7409. For renewals between 2 July 2023 and 1 July 2024, it applied under Provisional Article 2, introduced by Law No. 7456. If the relevant CPI rate was lower, that lower rate applied.

The temporary residential cap ceased to apply from 2 July 2024, while the CPI ceiling continued. Historical calculations must use the rule applicable on the renewal date. The temporary 25% cap did not apply to roofed workplace leases.

Commercial leases, foreign currency and the five-year rule

For workplace leases where the tenant is a trader or a legal entity, the CPI ceiling applies from 18 January 2019 under Law No. 7161. Article 344 became applicable in full to these leases on 1 July 2020. For older commercial renewals, the date therefore matters alongside the property type.

For rent denominated in a foreign currency, Article 344(4) provides that no increase may be made for five years. Once five years have elapsed, the landlord may bring proceedings for the determination of rent under Article 344(3), based on comparable rents and market rental value.

The optional lease start field is used for the five-year rule. Judicial determination based on comparable rents and market rental value is assessed independently of the CPI ceiling. The calculator’s ordinary renewal calculation does not establish the rent a court would determine. Its result is for information purposes.

Example: rent renewals in October 2026 and May 2024

For an October 2026 renewal with current monthly rent of TRY 20,000.00, the September 2026 CPI change based on twelve-month averages is 31.49%. Assuming no lower contractual rate, the increase is TRY 20,000.00 × 31.49% = TRY 6,298.00. The new monthly rent is TRY 26,298.00.

For a residential renewal in May 2024 with current monthly rent of TRY 10,000.00, the April 2024 CPI change based on twelve-month averages is 59.64%, but the temporary 25% cap applies. Assuming no lower contractual rate, the increase is TRY 2,500.00 and the new monthly rent is TRY 12,500.00. Both the data month and the rule applicable on the renewal date matter; these rates cannot be carried into other periods.

Frequently asked questions

Does the calculation use monthly inflation or the twelve-month average?

The Article 344(1) ceiling uses the CPI percentage change based on twelve-month averages. Monthly inflation is a different indicator. The relevant data is for the month before renewal.

Can a landlord increase the rent above CPI?

For an ordinary renewal, the agreed increase cannot exceed the Article 344(1) ceiling; any excess is invalid. Rent determination based on comparable rents and market rental value after five years is a separate assessment.

What if the lease specifies an increase below CPI?

A higher CPI ceiling does not automatically raise a lower contractual percentage. Both the agreed rate and the period’s legal ceiling must be considered.

Does the 25% residential rent cap still apply?

The temporary cap applied to residential leases renewing between 11 June 2022 and 1 July 2024. It ceased to apply from 2 July 2024 but remains relevant to historical calculations.

Are commercial rent increases also subject to CPI?

Roofed workplace leases are subject to the CPI ceiling. Historical application dates matter where the tenant is a trader or a legal entity. The temporary residential cap did not apply to these workplaces.

Can the calculator give a result before the relevant TÜİK data is published?

It does not estimate unpublished data or substitute an earlier period’s rate. The relevant TÜİK data must be published before the renewal calculation can be made.
