Compensation Calculator

Loss of earning capacity after a traffic or work accident
Estimate compensation for permanent loss of earning capacity using the actuarial method applied by Turkish courts: remaining life expectancy (TRH-2010), income during the active period, the net minimum wage for the passive period, the disability rate and contributory fault.
For information only, based on the law and published rates on the calculation date; it is not legal advice. Calculations powered by Emsal AI.
What the calculation covers
The calculation follows the tort provisions of the Turkish Code of Obligations (No. 6098, Articles 49–76; contributory fault under Article 52) and the settled practice of the Court of Cassation. Payments already received for the same loss are deducted. Non-pecuniary damages and claims for loss of support after a death are not included.
What the personal injury compensation result means
This calculator estimates financial compensation for permanent loss of earning capacity (sürekli iş göremezlik) following a traffic or work accident in Türkiye. It combines income, permanent disability and remaining life expectancy, then applies a reduction for the injured person’s own fault and deducts relevant payments.
The result is an approximate amount for this loss. It does not represent every possible claim arising from the accident. A calculation specific to the case requires an actuarial expert’s assessment.
Vehicle diminished value is covered by the separate vehicle diminished value calculator.
Understanding the calculator inputs
Under “Accident”, select “Traffic accident” or “Work accident or occupational disease”. The calculator uses active and passive periods to estimate the loss. The relevant payments to deduct depend on the selected category.
Enter “Age at the date of the accident” and select “Sex” as “Male” or “Female”. Age and remaining life expectancy determine the periods used in the calculation.
“Monthly net income at the time (TRY)” supplies the actual net income used for the active period. The passive period uses the net minimum wage.
“Permanent disability rate (%)” is the disability percentage used to calculate the loss from income.
“Injured person’s own fault (%)” is separate from disability. It reduces the calculated loss in proportion to the injured person’s own fault.
“Payments already received for the same loss (TRY)” accounts for the relevant insurance payment in a traffic accident or the capital value of the SGK benefit in a work accident.
How active and passive period losses are calculated
Remaining life expectancy is taken from the TRH-2010 Türkiye Life Table, used in the established practice of the Court of Cassation (Yargıtay). It supplies the time element of the calculation; it does not determine compensation on its own.
The active period runs up to age 60 and uses actual net income. The passive period runs from age 60 to the end of remaining life expectancy and uses the net minimum wage. The same salary is therefore not applied throughout the person’s remaining lifetime.
The method assumes equal annual income growth and discount rates of 10% each. On that basis, each period’s annual income is multiplied by its duration and the permanent disability rate. The two period losses are then added together.
Determine remaining life expectancy and the active and passive periods.
Calculate annual income using the applicable income basis for each period.
Multiply each annual income by the relevant period’s duration and the permanent disability rate.
Add the period losses before applying the fault reduction and deducting relevant payments.
Fault reduction and deduction of payments
The combined period losses do not, by themselves, show the compensation amount. Under Article 52 of the Turkish Code of Obligations, a reduction is applied in proportion to the injured person’s own fault.
Permanent disability and fault serve different purposes. Disability affects the loss calculated from income, whereas fault reduces that calculated loss. The two percentages must therefore be entered separately.
For a work accident, the capital value (peşin sermaye değeri) of the benefit awarded by SGK is deducted. For a traffic accident, the payment received from the insurer is deducted. Omitting a relevant payment affects the approximate result.
What the estimate leaves out
The calculator does not separately calculate the loss for the elapsed period between the accident date and the calculation date using actual wages. This is a limitation of the estimate.
Non-pecuniary compensation (manevi tazminat) and compensation for loss of support following death (destekten yoksun kalma tazminatı) are outside its scope. The displayed amount should not be treated as a complete valuation of the case.
The result is for information purposes. It does not replace the actuarial expert assessment required for a calculation specific to the case.
Example: Permanent disability compensation after an accident
The example concerns a 30-year-old man earning TRY 40,000.00 net per month, with 20% permanent disability and 25% own fault. His remaining life expectancy is 44.45 years.
The active period is 30 years, with annual income of TRY 480,000.00. The active period loss is 30 × TRY 480,000.00 × 20% = TRY 2,880,000.00.
The passive period is 14.45 years. Using the example’s 2026 monthly net minimum wage of TRY 28,075.50, equivalent to TRY 336,906.00 annually, the passive period loss is 14.45 × TRY 336,906.00 × 20% = TRY 973,658.34.
The total loss is TRY 3,853,658.34. Applying the 25% fault reduction leaves approximately TRY 2,890,243.76, rounded to two decimal places. No payment deduction is shown in this example; any relevant SGK or insurance payment must also be taken into account.
Frequently asked questions
Do traffic and work accidents use the same calculation method?
The calculator estimates loss arising from permanent incapacity for work through active and passive periods for both. The deductions differ: for a work accident, it deducts the capital value of the SGK benefit; for a traffic accident, it deducts the payment received from the insurer.
What is the TRH-2010 life table used for?
It provides remaining life expectancy for the calculation periods. The compensation estimate also depends on income, permanent disability, the injured person’s own fault and relevant payment deductions.
Why is my salary not used for my entire remaining lifetime?
This method uses actual net income for the active period up to age 60 and the net minimum wage for the subsequent passive period. Multiplying the current salary by the whole remaining lifetime would not follow that method.
Is permanent disability the same as my own fault?
No. Permanent disability affects the income loss calculation. Own fault is a separate percentage used to reduce the calculated loss under Article 52 of the Turkish Code of Obligations.
Does the result include non-pecuniary compensation or loss of support following death?
No. Both are excluded. The elapsed period between the accident and the calculation date is also not calculated separately using actual wages. The estimate therefore does not cover all claims in the case.
